1. Introductory Provisions
The mutual rights and obligations of the Buyer and Seller are governed by these Terms and Conditions. By submitting an order, the Buyer confirms that they have read the Terms and Conditions and agree to them.
The Seller and operator of the online store https://thelunacare.com is: LUNAcare DP Ltd., LC 30 N Gould St Ste 3636, Sheridan, WY 82801, USA. Registration ID (Filing ID): 2019-000856373.
2. Formation of the Purchase Contract
A properly completed order submitted via the online store https://thelunacare.com (or by email) by the Buyer constitutes a binding offer to conclude a purchase contract with the Seller, whereby the Buyer is bound by their offer for 21 days from the date the order is sent.
The Seller will immediately acknowledge receipt of the order by email to the email address provided by the Buyer in the order. The purchase contract itself is concluded upon acceptance of the offer by the Seller, with acceptance being deemed to occur when the Seller dispatches the goods to the Buyer.
After conclusion, the purchase contract is archived only for the period strictly necessary for its fulfilment, during which time it may be made available to the consumer upon written request. Changes to an order and correction of errors may be made up until the moment the goods are handed over for dispatch.
3. Consumer's Right of Withdrawal
Menstrual cup: the consumer has no right to withdraw from the contract as the nature of the goods excludes this for hygiene reasons.
Menstrual underwear may be returned within 14 days of receipt of the goods, provided the following rules are observed: hygiene precautions must be maintained during fitting — underwear must always be tried on over clean, washed personal underwear, never directly on bare skin. If the stipulated hygiene conditions are not met, the goods would be considered used goods which, pursuant to Directive 97/7/EC on the protection of consumers in respect of distance contracts, cannot be returned due to their nature.
4. Payment Terms and Delivery Terms

- Google Pay and Apple Pay
The Seller undertakes to dispatch the goods as soon as possible.
5. Warranty
- The warranty on the menstrual cup is 5 years. For cups with a release mechanism the warranty is 2 years.
- For accessories (sterilisation bag and storage pouch) and other products, a 2-year warranty applies.
- Menstrual underwear: 2 years, with an extended 3-year warranty on the functional layer.
To make a warranty claim, the consumer should send an electronic message to the store (see the Contact page at thelunacare.com) stating:
- Â email address
- Â which goods are being claimed
- Â description of the defect
- Â full name
- address to which defect-free goods should be sent, including the country
Claims will be processed within 30 days. If the claim is approved, the consumer will be sent new defect-free goods.
This warranty applies to both Consumers and Buyers who are not consumers (wholesale partners, B2B).
6. Prices and Validity of Offers
All product and service prices are final (inclusive of VAT applicable at the time the order is submitted).
7. Protection of Personal Data
All personal data communicated to the Seller will not be provided to third parties or other entities without the Buyer's consent, except where necessary for the fulfilment of the purchase contract (e.g. for delivery of goods), and will be handled in accordance with applicable data protection legislation.
The Buyer consents to the processing of their personal data by the Seller also for the purpose of sending information and commercial communications to the Buyer.
By accessing the website https://thelunacare.com, the Buyer consents to the storage of so-called cookies and pixel tags on their device.

8. Electronic Invoicing
Upon request, the consumer will be issued a proof of purchase in the form of an electronic invoice sent to their email address.
9. Final Provisions
The parties agree that the relationship is governed by the law of the country to which the goods are delivered.
All disputes arising between the Seller and the Consumer (Buyer) shall be resolved by the parties out of court, i.e. by mutual agreement.
If the parties cannot reach an agreement, the relevant body for handling out-of-court complaints by the buyer is the appropriate organisation representing this role in the buyer's country.
Within the European Union, the ODR platform may be used.
 These Terms and Conditions take effect on 1 August 2023.
